Preface

The predecessor of Guangdong Pharmaceutical University (hereinafter referred to as the school) was the Guangdong Provincial Health Cadres Continuing Education College established in June 1958. In December 1978, Guangdong Medical College was established on the basis of the Guangdong Provincial Health Cadres Continuing Education College. It was renamed Guangdong Pharmaceutical College in February 1994 and Guangdong Pharmaceutical University in March 2016.

Chapter I General Provisions

Article 1 This Charter is formulated in accordance with the Education Law of the People’s Republic of China, the Higher Education Law of the People’s Republic of China, the Teachers Law of the People’s Republic of China and other laws and regulations, with reference to the Interim Measures for the Formulation of Charters of Institutions of Higher Education, and in combination with the actual situation of the school, in order to safeguard and promote the school’s independent operation in accordance with the law, clarify the rights and obligations of the school, standardize the school’s operating behavior, and promote the scientific development of the school.

Article 2 The Chinese name of the school is Guangdong Pharmaceutical University, abbreviated as “Guangdong Pharmaceutical University” in Chinese; the English name is Guangdong Pharmaceutical University, abbreviated as GDPU.

Article 3 The legal registered address of the school is No. 40 Guanghanzhi Street, Baogang District, Haizhu District, Guangzhou.
    The school has three campuses and five campuses, namely Guangzhou Campus (University Town Campus, Chigang Campus, Baogang Campus), Zhongshan Campus (campus) and Yunfu Campus (campus).

With the approval of the organizer and the education administrative department, the school may establish and adjust campuses according to the needs of running the school.

Article 4 The school is a full-time general higher education institution organized by the People’s Government of Guangdong Province. It is a non-profit institution legal person, and its education administrative department is the Guangdong Provincial Department of Education. The relationship between the school and the organizer and the education administrative department shall comply with the Higher Education Law of the People’s Republic of China and other relevant laws and regulations.

Article 5 The school is guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, adheres to the overall leadership of the Communist Party of China, implements the Party’s education policy, adheres to the socialist direction of running schools, adheres to the public nature of education, strengthens the education of socialist core values ​​for the educated, implements the fundamental task of moral education, and cultivates socialist builders and successors with all-round development of morality, intelligence, physique, aesthetics, and labor.

Article 6 The school enjoys the following rights according to law:

(1) To determine and adjust the annual enrollment plan, adjust the enrollment ratio of each major, and decide on the standards and procedures for admission of students based on social needs, school conditions and the school scale approved by the State;

(2) Establishing and adjusting disciplines and majors;

(3) Formulate talent training programs and organize and implement teaching activities;

(4) To carry out scientific research, technological development and social service activities;

(5) To carry out exchanges and cooperation with various entities such as domestic and foreign universities, research institutions and enterprises;

(6) Determine the establishment of internal institutions of the school and decide on the staffing of each institution;

(VII) Adjusting the job structure ratio, assessing the positions of employed personnel, and determining the internal income distribution system;

(8) Manage and use school assets and funds;

(IX) Other major matters that can be decided independently in accordance with laws, regulations, rules and relevant provisions.

Article 7 The school shall perform the following obligations in accordance with the law:

(1) To abide by the relevant provisions of laws, regulations and this Constitution, fully implement the Party’s educational principles, and execute the national educational policies;

(2) Implement the fundamental task of cultivating morality and educating people, and conscientiously perform the main functions of talent cultivation, scientific research, social services, cultural inheritance and innovation, and international exchanges and cooperation;

(3) Implement national education and teaching standards and ensure the quality of education and teaching;

(4) safeguarding the legitimate rights and interests of students and faculty members;

(5) Collect fees in accordance with relevant national regulations and make public the fee items;

(6) accepting supervision and guidance from organizers and education administrative departments in accordance with the law;

(VII) Other obligations prescribed by laws and regulations.

Article 8 The school organizer shall provide guidance and supervision to the school in accordance with the law, provide the school with funds and basic guarantee conditions for running the school, protect the legitimate rights and interests of the school, and support the school to run the school independently in accordance with laws, regulations and school charters.

Article 9 The school focuses on undergraduate and postgraduate education, with full-time academic education as the main form of education. It also appropriately carries out academic continuing education and various forms of non-academic continuing education based on social needs.

The school carries out foreign-related educational activities, education for international students and students from Hong Kong, Macao and Taiwan, non-academic education activities and other educational cooperation projects in accordance with laws and regulations.

Article 10 The school adheres to the principle of focusing on medicine, combining medicine with medicine, integrating medicine with engineering, and developing multiple disciplines in a coordinated manner.

The school has established disciplines such as medicine, science, engineering, management, economics, literature, and law, and can adjust them according to development needs.

Article 11 The school implements the principal responsibility system under the leadership of the Communist Party of China Guangdong Pharmaceutical University Committee (hereinafter referred to as the school party committee).

The school implements an internal governance system that is mainly based on school and college management, and can adjust the management model independently in accordance with the law.

The school implements professorial governance, strengthens the role of the academic committee, and safeguards academic freedom and autonomy in accordance with the law.

The school implements democratic management and protects the rights of faculty and students to know, supervise and participate in school management in accordance with the law.

Article 12 The school party committee plenary session, the party committee standing committee, and the principal’s office shall collectively study and decide on major matters such as major school decisions, important personnel appointments and removals, major project arrangements, and the use of large amounts of funds based on the scope of discussion and rules of procedure.

The school has improved the major administrative decision-making procedures of public participation, expert discussion, risk assessment, and collective discussion and decision-making, and established a legal advisory system to provide legal argumentation and consultation on major decisions of the school.

Chapter II Governance Structure
Section 1 Leadership System

Article 13 The school party committee is the leadership core of the school. In accordance with the “Higher Education Law of the People’s Republic of China” and relevant regulations, it shall comprehensively lead the work of the school, assume the main responsibility for managing the party and running the school, play a leading role in setting the direction, managing the overall situation, making decisions, building a team, leading the team, and ensuring implementation, perform the various duties prescribed by the Party Constitution, support the principal to actively, independently and responsibly carry out his work in accordance with the provisions of laws and regulations, and ensure the completion of various tasks such as teaching, scientific research, and administrative management.

The Party Committee Secretary presides over the overall work of the school Party Committee and performs his duties in accordance with the relevant policies of the Party and the State.

Article 14 The main responsibilities of the school party committee are:

1. To publicize and implement the Party’s line, principles and policies, and the resolutions of the Party Central Committee, higher-level Party organizations and the organization itself; to adhere to the socialist orientation of running schools, to run schools in accordance with the law, to promote the scientific development of the school by relying on all teachers, students and staff, and to cultivate socialist builders and successors with all-round development in morality, intelligence, physique, aesthetics and labor;

(2) Adhere to the guiding role of Marxism, organize Party members to earnestly study Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of “Three Represents”, the Scientific Outlook on Development, Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, the Party’s lines, principles, policies and resolutions, basic Party knowledge, professional knowledge and knowledge of science, history, culture, law and other aspects;

(3) Review and determine the basic management system of the school, discuss and decide on major issues concerning the school’s reform, development, stability, teaching, scientific research, and administrative management;

(IV) Discuss and decide on the establishment of the internal organizational structure of the school and the candidates for their leaders. Responsible for the education, training, selection, assessment and supervision of cadres in accordance with the authority of cadre management. Strengthen the construction of the leadership team, cadre team and talent team. Decide on the school’s talent work plan and major talent policies, innovate the talent work system and mechanism, optimize the talent growth environment, and coordinate the construction of various talent teams in the school. Recommend candidates for school-level leading cadres and reserve cadres in accordance with relevant procedures. Do a good job in the work of veteran cadres;

(V) Strengthen the construction of the school’s party organization in accordance with the requirements of the party’s self-management and comprehensive and strict governance of the party. Implement the grassroots party building responsibility system, strengthen the leadership of the grassroots party organizations of the school’s colleges (departments), do a good job in recruiting party members and educating, managing and serving party members, develop grassroots democracy within the party, and give full play to the role of the grassroots party organizations of the school as a fighting fortress and the vanguard and exemplary role of party members;

(6) Perform the principal responsibility of comprehensively and strictly governing the Party in the school, lead and support the internal disciplinary inspection organization in performing its duties of supervision, discipline enforcement and accountability, and accept supervision from the disciplinary inspection organization at the same level and the higher-level disciplinary inspection and supervision committee and its dispatched disciplinary inspection and supervision agencies;

(VII) Lead the school’s ideological and political work and moral education work, implement the ideological work responsibility system, maintain school safety and stability, and promote the construction of a harmonious campus. Strengthen the construction of university culture, give full play to the role of culture in educating people, and cultivate a good school spirit, academic style and teaching style;

(8) Lead the university’s mass organizations, academic organizations, and faculty and staff congresses;

(IX) Do a good job in the work of the united front. Exercise political leadership over the grassroots organizations of democratic parties in the school and support them in carrying out activities in accordance with their respective charters. Support non-party members and other members of the united front to participate in related activities of the united front and play an active role. Strengthen the work of non-party intellectuals and the construction of a team of non-party representatives. Strengthen ethnic and religious work, carry out in-depth education on forging a strong sense of community for the Chinese nation, and resolutely prevent and resist all kinds of illegal missionary and infiltration activities;

(10) Discuss and decide on other important matters concerning the vital interests of teachers, students and staff.
The school party committee is elected by the Party Congress of Guangdong Pharmaceutical University of the Communist Party of China (hereinafter referred to as the Party Congress), and each term of office is 5 years. The school party committee is responsible to and reports to the Party Congress. The plenary meeting of the school party committee (hereinafter referred to as the plenary committee) leads the overall work of the school during the adjournment of the Party Congress.

The plenary session elects the Standing Committee of the Party Committee (hereinafter referred to as the Standing Committee). When the plenary session is not in session, its duties shall be performed by the Standing Committee.

The school party committee adheres to the democratic centralism and implements the basic system of “collective leadership, democratic centralism, individual deliberation, and meeting decision” for deliberation and decision-making. The rules of procedure for the plenary meeting and the standing committee of the school party committee will be formulated separately.

Article 15 The Discipline Inspection Commission of Guangdong Pharmaceutical University of the Communist Party of China (hereinafter referred to as the School Discipline Inspection Commission) is the school’s dedicated agency for intra-party supervision. It works under the dual leadership of the school party committee and the superior discipline inspection commission. In accordance with the party constitution and intra-party regulations, it performs the responsibility of comprehensive and strict supervision of the party, and safeguards and promotes the healthy development of all undertakings of the school.

Article 16 The Guangdong Provincial Supervision Commission shall establish an Office of the Supervisory Commissioner in the school, which shall be co-located with the school’s Discipline Inspection Commission. The Office of the Supervisory Commissioner shall perform supervisory duties in accordance with the authorization of the superior Discipline Inspection Commission and Supervision Commission.

Article 17 The principal is the legal representative of the school. Under the leadership of the school party committee, he or she shall implement the party’s education policy, organize and implement the relevant resolutions of the school party committee, exercise the various powers prescribed by laws and regulations, and be fully responsible for teaching, scientific research, and administrative management.

The vice-principal assists the principal in his work.

Article 18 The principal shall exercise the following powers in accordance with the law:

(1) Organize the formulation and implementation of the school development plan, basic management system, important administrative rules and regulations, major teaching and scientific research reform measures, and important school resource allocation plans. Organize the formulation and implementation of specific rules and regulations and annual work plans;

(2) Organize the formulation and implementation of the establishment plan of the school’s internal organizational structure. Recommend candidates for vice presidents and appoint and remove heads of internal organizational structures in accordance with the law and relevant provisions on cadre selection and appointment;

(3) Organize the formulation and implementation of the school’s talent development plan, important talent policies and major talent project plans. Be responsible for the construction of the teaching staff, and appoint and dismiss teachers and other internal staff in accordance with relevant regulations;

(iv) Organize the formulation and implementation of major school infrastructure, annual budget and other plans. Strengthen financial management and audit supervision, and manage and protect school assets;

(5) Organize and carry out teaching activities and scientific research, innovate talent training mechanisms, improve the quality of talent training, promote cultural inheritance and innovation, serve the national and local economic and social development, and make the school distinctive and strive to be first-class;

(6) Organize and carry out ideological and political work and moral education, be responsible for the management of student enrollment and implement rewards or penalties, and carry out enrollment and employment work;

(VII) Ensure school safety, stability and logistical support;

(8) Organize and carry out the school’s external exchanges and cooperation, sign cooperation agreements with governments at all levels, all sectors of society and overseas institutions on behalf of the school in accordance with the law, and accept social donations;

(IX) Report to the Party Committee on the implementation of major resolutions, report work to the Faculty and Staff Congress, and organize the processing of proposals on administrative work from the Faculty and Staff Congress, the Trade Union Congress, the Student Congress, and the Graduate Student Congress. Support the Party organizations at all levels, grassroots organizations of democratic parties, mass organizations, and academic organizations of the school to carry out their work in accordance with laws and regulations;

(10) Other powers prescribed by laws, regulations and the school charter.

Article 19 The principal’s office meeting is the school’s administrative deliberative and decision-making body. It mainly studies and proposes plans for important matters to be discussed and decided by the Party Committee, specifically deploys and implements relevant measures of the Party Committee’s resolutions, and studies and handles teaching, scientific research, and administrative management work.

The meeting is convened and chaired by the principal. If the principal cannot attend the meeting for some reason, the vice-principal appointed by him shall convene and chair the meeting. The meeting members are members of the school’s administrative leadership team. The meeting topics are proposed by members of the school’s administrative leadership team and determined by the principal. The meeting can only be held if more than 1/2 of the members are present. The principal should make decisions on the matters under discussion based on extensive listening to the opinions of the participants. The party secretary, deputy secretary, and discipline inspection committee secretary may attend the meeting depending on the topic.

Other matters of the principal’s office meeting shall be handled in accordance with the rules of procedure of the principal’s office meeting.

Section 2 Academic Organizations

Article 20 The Academic Committee is the highest academic institution in the school, and is responsible for the overall decision-making, review, evaluation and consultation of the school’s academic affairs.

The school builds an academic integrity system that integrates education, prevention, supervision, and punishment, establishes a work mechanism for academic style construction led by the main person in charge, and clarifies the division of responsibilities; based on the “Measures for the Prevention and Handling of Academic Misconduct in Higher Education Institutions”, it improves the school’s rules and procedures for preventing and handling academic misconduct.

The school gives full play to the role of the Academic Committee in building academic style, supports and guarantees the Academic Committee to perform its duties in accordance with the law, and investigates and identifies academic misconduct.

The Academic Committee is composed of professors from different disciplines and majors of the school and personnel with professional and technical positions above the senior level, and a certain proportion of young teachers. The number of members of the Academic Committee matches the disciplines and majors of the school, and is an odd number of not less than 15. Among them, the number of members who hold party and government leadership positions in the school and functional departments shall not exceed 1/4 of the total number of members; the number of full-time professors who do not hold party and government leadership positions or are the main persons in charge of colleges (departments) shall not be less than 1/2 of the total number of members.

The members and chairman of the Academic Committee are elected in accordance with its charter and appointed by the president. The members are appointed for a term of 4 years and can be re-elected, but the maximum number of consecutive terms is no more than 2. At each election of the Academic Committee, the number of re-elected members shall not exceed 2/3 of the total number of members.

The Academic Committee shall have one chairman and several vice-chairmen as needed. The Academic Committee shall implement a regular meeting system and hold at least one plenary meeting every semester. According to work needs, upon the proposal of the chairman of the Academic Committee or the president, or a joint proposal of more than 1/3 of the members, a plenary meeting of the Academic Committee may be held temporarily to discuss and decide on relevant matters.

The Academic Committee meeting shall be convened and presided over by the Chairman. If necessary, it may be convened and presided over by the Vice Chairman entrusted by him. The plenary meeting of the Academic Committee shall be held only if more than 2/3 of the members are present. The Academic Committee shall make decisions based on the principle of minority obeying majority and make decisions by voting. Major matters shall be approved only if more than 2/3 of all members agree.

The Academic Committee shall establish a secretariat to handle the daily affairs of the Academic Committee.

Article 21 Before making decisions on the following matters, the University shall submit them to the Academic Committee for review, or the Academic Committee shall review and make a decision directly:

(1) Plans for the development of disciplines, majors and teaching staff, as well as major academic plans such as scientific research, and international academic exchanges and cooperation;

(2) Independently setting up or applying to set up academic disciplines and majors;

(3) Plans for setting up academic institutions, plans for building interdisciplinary and cross-disciplinary collaborative innovation mechanisms, and plans for allocating disciplinary resources;

(iv) Evaluation standards and assessment methods for teaching and scientific research achievements and the quality of talent training;

(5) Degree awarding standards and detailed rules, training standards for academic education, teaching plans and programs, and admissions standards and methods;

(6) The academic standards and methods for the appointment of teachers in the school;

(VII) Academic evaluation and dispute resolution rules;

(8) Academic ethics and scientific ethics;

(IX) The organizational rules of the special committees of the Academic Committee and the charters of the academic subcommittees;

(10) Other academic matters that the school deems necessary to be submitted for review.

Article 22 The following matters of the University involving the evaluation of academic level shall be evaluated by the Academic Committee or its authorized academic organization:

(1) The school’s teaching and scientific research achievements and awards, and external recommendations for teaching and scientific research achievement awards;

(2) Recommending candidates for high-level talent recruitment positions, candidates for appointment of honorary (visiting, distinguished) professors, and candidates for appointment to important academic organizations at home and abroad, and candidates for talent selection and training programs;

(3) Independently establish various academic and scientific research funds, scientific research projects, and teaching and scientific research awards;

(IV) Other matters requiring evaluation of academic standards.

The Academic Committee accepts reports of academic misconduct and conducts investigations and adjudicates academic disputes in accordance with relevant regulations and the school’s entrustment.

Article 23 Before the university makes the following decisions, it shall inform the Academic Committee, which shall provide advisory opinions:

(1) Formulate overall and major development plans and strategies related to academic affairs;

(2) The arrangement, allocation and use of teaching and scientific research funds in the university’s budget and final accounts;

(3) Application for major teaching and scientific research projects and allocation and use of funds;

(iv) Carry out Sino-foreign cooperative education, run schools overseas, and carry out major foreign cooperation projects;

(V) Other matters that the University deems necessary to seek the opinions of the Academic Committee.

Article 24 The Academic Committee may set up special committees for discipline construction, teaching guidance, scientific research, academic ethics, scientific ethics and other matters, which shall specifically assume relevant responsibilities and academic affairs; academic subcommittees shall be set up in secondary colleges (departments) and assume corresponding responsibilities. Each special committee and academic subcommittee shall be established and carry out its work in accordance with legal provisions, the authorization of the Academic Committee and the organizational regulations or charter approved by the school, report its work to the Academic Committee, and accept the guidance and supervision of the Academic Committee.

Article 25 The University shall establish a degree evaluation committee in accordance with the law. The degree evaluation committee is the decision-making body for the university’s degree affairs and is established in accordance with laws, regulations and the charter approved by the university. The president is the chairman of the degree evaluation committee.

The main responsibilities of the Degree Evaluation Committee are:

1. Adopting the degree management system;

(2) Reviewing the adjustment or cancellation of degree-granting institutions;

(3) A list of candidates whose degree applications have been approved;

(4) Make decisions on the awarding of bachelor’s degrees, master’s degrees and doctoral degrees;

(5) Making decisions to cancel the qualifications for applying for a degree or to revoke a degree that has been awarded;

(6) Review and decide on the selection criteria and methods for graduate student supervisors;

(VII) Accepting and resolving complaints related to degree awarding and graduate student training;

(8) To study and handle other matters related to degree and postgraduate education.

The Degree Evaluation Committee sets up degree evaluation subcommittees in secondary colleges (departments). Each subcommittee is established and carries out its work in accordance with the authorization of the Degree Evaluation Committee and the regulations approved by the school.

Section 3 Democratic Management

Article 26 The Faculty and Staff Congress is the basic form for faculty and staff to participate in the democratic management and supervision of the school in accordance with the law. The school shall establish and improve the Faculty and Staff Congress system. The representatives of the Faculty and Staff Congress shall be elected by all faculty and staff of the school in accordance with the law, among which the number of teacher representatives shall not be less than 60% of the total number of representatives, and a certain proportion of young teachers and female teachers shall be guaranteed.

The functions and powers of the Faculty and Staff Congress are:

(1) Listen to the report on the formulation and revision of the draft school charter and put forward opinions and suggestions for revision;

(2) Listen to reports on the school’s development plan, faculty and staff team building, education and teaching reform, campus construction, and other major reforms and solutions to major issues, and put forward opinions and suggestions;

(3) Listen to the school’s annual work, financial work, trade union work reports and other special work reports, and put forward opinions and suggestions;

(4) Discuss and approve the welfare and on-campus allocation implementation plans directly related to the interests of faculty and staff, as well as the corresponding faculty and staff appointment, assessment, reward and punishment measures proposed by the school;

(5) Review the report on the handling of proposals submitted by the previous session of the University’s Faculty and Staff Representative Conference;

(6) Evaluate the school’s leading cadres in accordance with relevant work regulations and arrangements;

(VII) To make comments and suggestions on the school’s work through various means, supervise the implementation of the school’s charter, rules and regulations, and decisions, and make comments and suggestions on rectification;

(8) Discuss other matters stipulated by laws, regulations and rules, as well as other matters agreed upon by the school and the school union.

The opinions and suggestions of the faculty and staff representative conference shall be made in the form of meeting resolutions.

The operation, rules of procedure and other matters of the Faculty and Staff Representative Conference shall be implemented in accordance with the relevant regulations of the Faculty and Staff Representative Conference.

The school union is the working body of the Faculty and Staff Congress and is responsible for its daily work during the recess of the Faculty and Staff Congress.

Article 27 The Communist Youth League Committee of Guangdong Pharmaceutical University (hereinafter referred to as the school Youth League Committee) shall carry out its work in accordance with the Constitution of the Communist Youth League of China and participate in the democratic management and supervision of the school under the leadership of the school party committee and the guidance of the higher-level Youth League Committee. The school has established Youth League Committees at the school and college levels.

The Student Representative Congress and Graduate Student Representative Congress are the highest authority of the Student Union and Graduate Student Union, and are the basic organizational form for students to participate in the democratic management and supervision of the school. The Student Representative Congress and Graduate Student Representative Congress of the school carry out activities under the leadership of the school party committee and the guidance of the school youth league committee, and exercise the following powers:

1. Listen to, review and approve the work reports of the Student Union and Graduate Student Union;

(2) Elect new leadership of the Student Union and Graduate Student Union;

(3) Discuss and decide on the work direction and tasks of the Association;

(4) Formulate and revise the charters of the Student Union and Graduate Student Union;

(V) Review the proposal work report and provide feedback on the handling of relevant proposals;

(6) Discuss school rules and regulations and reform plans that affect students’ vital interests, and put forward opinions and suggestions on school work;

(VII) Other powers stipulated by laws, regulations, rules and granted by the school.

The Student Congress and the Graduate Student Congress carry out their work in accordance with their charters.

Article 28 The grassroots organizations of democratic parties in the school, mass organizations such as the trade union, the Youth League Committee, and the student union, graduate student union and other mass organizations shall independently carry out their work and participate in the democratic management of the school under the leadership of the school party committee in accordance with the laws, regulations, school rules and regulations and their respective charters.

The school provides the necessary conditions and financial support for the grassroots organizations of democratic parties, mass organizations and mass organizations.

Chapter III Internal Organizations

Article 29 The school shall establish functional departments and teaching auxiliary units according to actual needs and the principles of streamlining and efficiency, and may change, cancel or adjust their functions according to actual conditions.
The functional departments and teaching auxiliary units of the school are the working bodies for school management, service and operation. According to the authorization of the school, they shall perform their respective duties and ensure the effective operation of the school.

Article 30 The school shall establish teaching and research units such as colleges (departments), research institutes (institutes, centers), and key laboratories, and may change or cancel the school’s teaching and research units in accordance with relevant regulations.

Under the unified leadership and guidance of the school, the colleges (departments) independently organize and carry out various tasks such as talent training, discipline construction, scientific research, foreign exchanges and cooperation, etc. The school grants the colleges (departments) corresponding management authority and responsibilities in terms of personnel, finance, and materials, and guides and supervises the colleges (departments) to manage themselves within the scope of the school’s authorization.

Article 31 The functions and powers of the college (department) are:

(1) Formulate and implement the development plans of colleges and departments according to the overall development plan of the university, and carry out talent training, discipline construction, academic research and other academic activities;

(2) To establish, change or abolish the internal institutions of the institute (department);

(3) Formulate and implement the work system and procedures of the institute (department) in accordance with the school’s charter and rules and regulations;

(4) To supervise the faculty and staff of the college (department) in fulfilling their employment contracts and to conduct assessment and management of the faculty and staff of the college (department);

(5) Educate and manage students in accordance with relevant regulations;

(6) Manage and reasonably use the school funds, equipment and other assets allocated by the school;

(VII) Exercise other powers granted by the school.

Other teaching and research units shall perform their duties in accordance with their established purposes, work objectives and authorization by the school.

Colleges (departments) and other teaching and research units are subject to the management and supervision of the school when exercising their powers.

Article 32 The dean (director) is the principal administrative person in charge of the college (department) and is fully responsible for the teaching, scientific research and administrative management of the college (department).

The dean (director) shall report his/her work to all faculty and staff of the college (department) or to the faculty and staff representative assembly on a regular basis.

Article 33 The Party Committee (Party Branch) of the College (Department) is the political core of the College (Department), fulfilling political responsibilities, ensuring the completion of various tasks such as teaching, scientific research and management, supporting the administrative leadership team and the person in charge of the unit to carry out their work, and improving the working mechanism of collective leadership, division of labor and cooperation between the Party and the government, and coordinated operation. The main responsibilities are:

(1) To publicize and implement the Party’s lines, principles, policies and resolutions of the school Party committee, and to ensure and supervise their implementation;

(2) Discuss and decide important matters of the unit through the joint party and government conference. Convene party organization meetings to study and decide on party building work such as cadre appointments and party member team building. Matters involving the direction of running schools, teacher team building, and the vital interests of teachers, students and staff should be studied and discussed by the party organization before being submitted to the joint party and government conference for decision;

(3) Strengthen the construction of the Party organization itself, establish and improve systems such as regular meetings of Party branch secretaries, and provide specific guidance to Party branches in carrying out their work;

(IV) Lead the ideological and political work of the unit, strengthen the construction of teachers’ ethics and style, and implement the responsibility system for ideological work. Ensure the political integrity of important work such as teacher recruitment, curriculum construction, textbook selection, and academic activities;

(5) To do a good job in the education and management of party members and cadres in the unit, and to do a good job in the education, guidance and contact and service of talents;

(6) Lead the mass organizations, academic organizations and faculty and staff congresses of the unit and do a good job in united front work.

Party branches are set up in units below the college (department), corresponding to teaching, scientific research, management, service and other institutions. The Party branch of faculty and staff carries out work around the reform, development and stability of the unit, implements the fundamental task of cultivating morality and cultivating people, plays the role of educating, managing and supervising party members and organizing propaganda to gather and serve teachers, students and staff, ensures that the Party branch of faculty and staff participates in the decision-making of major issues of the unit, supports the work of the administrative head of the unit, and conducts political screening for the evaluation of faculty and staff professional titles, job promotions, and assessments. The student Party branch should strengthen ideological and political guidance, lay a solid foundation for students’ ideals and beliefs, and guide students to study hard, develop comprehensively, and grow healthily. The main responsibilities of the Party branch of faculty and staff and the student Party branch shall be implemented in accordance with the relevant requirements of the “Regulations on the Work of Grassroots Organizations of the Communist Party of China in Ordinary Colleges and Universities”.

Article 34 The Party-Government Joint Conference is the basic system and main form of deliberation and decision-making of the college (department). Major matters and important issues such as talent training, scientific research, discipline construction, team building, financial assets, ideological and political work of the college (department) are collectively discussed and decided in accordance with the rules of procedure.

The president (director) and the secretary of the Party Committee (Party Branch) shall respectively preside over the party-government joint meeting according to the content of the meeting.

The rules of procedure for the Party-Government Joint Conference shall be formulated separately.

Article 35 The college (department) shall establish a grassroots trade union organization and implement the system of faculty and staff representative conference or faculty and staff conference. Under the leadership of the college (department) party committee (general party branch), it shall ensure that faculty and staff participate in the democratic management and democratic supervision of the college (department) and safeguard the legitimate rights and interests of faculty and staff.

Article 36 The college (department) shall establish an academic subcommittee, which shall be established and carry out its work in accordance with the authorization of the school’s academic committee and the organizational rules or charter approved by the school.

Chapter 4 Directly Affiliated Hospitals

Article 37 A directly affiliated hospital is an independent legal entity that has an affiliation with the school and is the unit that provides medical services to the society.

Article 38 The school shall appoint and remove the president and other management personnel of its affiliated hospitals in accordance with relevant national regulations, except where otherwise provided by laws and regulations.

Article 39: As the clinical teaching unit of the school, the directly affiliated hospital shall perform the duties of teaching, academic research and talent training according to the authorization of the school.

Article 40 Directly affiliated hospitals shall be subject to the management and supervision of the school in performing the duties assigned by the school. Specific matters shall be implemented in accordance with the management measures for directly affiliated hospitals formulated by the school.

Chapter V School Activities

Article 41 The fundamental task of the school is to cultivate morality and educate people.
The school fully implements the Party’s education policy, emphasizes the cultivation of social responsibility and core values, and cultivates senior medical talents with solid foundation, broad knowledge, and strong practical innovation ability.

Article 42 The school shall determine and adjust the length of study for academic education in accordance with the law and implement a credit system and a flexible academic system.

The school will issue academic certificates to students who have completed the teaching plan and passed the assessment, and will confer bachelor’s, master’s and doctoral degrees in accordance with the law.

Article 43 The school shall formulate talent cultivation plans, innovate talent cultivation mechanisms, and improve the collaborative education system based on the laws of talent cultivation and adapt to the needs of social development.

The school has established a teaching quality monitoring system that focuses on internal quality control and involves the participation of multiple parties, and publishes an annual teaching quality report.

Article 44 The school attaches importance to basic research, strives to strengthen applied research, actively carries out technological development work, encourages the integration of production, learning, research and application, and promotes scientific and technological innovation and transformation of results.

The school implements a two-level scientific research management system: school and college (institute, center).

The school has established an academic evaluation system that is oriented towards quality and innovation.

Article 45 The University encourages academic innovation, safeguards academic freedom, promotes a rigorous and realistic style of study, opposes academic misconduct, and adheres to academic ethics.

Article 46 The University promotes the scientific spirit and humanistic spirit, and is committed to promoting international medical and cultural exchanges and the dissemination of China’s excellent culture.

Chapter VI Faculty and Staff

Article 47 The school staff consists of teachers, other professional and technical personnel, management personnel, and workers.

Faculty and staff shall perform their duties in accordance with the terms of their employment contracts and job requirements.

Article 48 The school shall appoint, assess, promote, reward, punish, and dismiss faculty and staff in accordance with the law. The specific methods shall be implemented in accordance with the relevant school systems.

The school provides the necessary conditions for the work of faculty and staff and guarantees their welfare benefits.

Article 49 Faculty and staff shall enjoy the following rights:

(1) Carry out teaching, scientific research, management, service or other work required by the position, participate in academic groups and carry out academic activities;

(2) Reasonably use the school’s public resources in accordance with job responsibilities and relevant management systems;

(3) To receive fair evaluation in terms of moral character, ability and performance, and to receive fair awards and honorary titles at all levels and of all kinds;

(4) To be aware of the school’s reform, construction and development and major matters concerning personal interests;

(5) To participate in the democratic management and democratic supervision of the school and to put forward opinions and suggestions on the work of the school;

(6) Fair access to opportunities and conditions for personal development such as further study and training;

(VII) Receive salary and remuneration according to the appointed position or post, and enjoy welfare benefits prescribed by the state, province and school;

(8) Expressing objections to the school and the education administrative department and filing complaints in accordance with the law regarding matters such as job appointments, welfare benefits, awards and honors, and disciplinary sanctions;

(IX) Other rights stipulated by laws, regulations, rules, these Articles of Association and the contract.

Article 50 Faculty and staff shall fulfill the following obligations:

(1) Abide by the Constitution, laws and professional ethics, and constantly improve ideological and political awareness and educational and teaching professional standards;

(2) Adhere to the principles of teaching, management and service to educate students, perform job duties, complete work tasks and accept school assessment;

(3) Respect and care for students, protect their lawful rights and interests, stop any behavior that is harmful to students or that infringes upon their lawful rights and interests, and resist any phenomenon that is harmful to the healthy growth of students;

(4) Comply with academic norms and uphold academic ethics;

(5) Maintain the reputation of the school and the legitimate interests of the school, and abide by the school rules and regulations;

(6) Other obligations required by laws, regulations, rules, this Charter and the contract.

Article 51 The school shall establish and implement the following systems to protect the legitimate rights and interests of faculty and staff:

(1) A welfare system for faculty and staff that is appropriate to the school’s development level and financial resources;

(2) A system of commendation and rewards for faculty and staff who have made outstanding achievements and contributions to the country and the university;

(3) A development system for the training and cultivation of teaching staff that is compatible with the development of the school, the construction of disciplines, and the needs of positions;

(4) A system of assistance for faculty and staff whose families are in financial difficulties;

(5) Participation in the democratic management system of school affairs;

(6) Other systems for protecting the legitimate rights and interests of faculty and staff as provided for by laws and regulations.

Article 52 The school shall set up a faculty and staff complaint handling committee to accept and resolve faculty and staff complaints. The composition and working procedures of the school faculty and staff complaint handling committee shall be implemented in accordance with the faculty and staff complaint handling measures.

Article 53 The school implements a post setting and personnel employment system, and faculty and staff are included in the corresponding series of post management based on the positions they are employed.

The school shall establish a professional title evaluation committee, which shall independently organize professional title evaluation and self-evaluation within the proportion of the job structure according to the evaluation authority. The composition rules and rules of procedure of the professional title evaluation committee shall be formulated separately.

The school conducts annual and contract-term assessments on faculty and staff, and the assessment results serve as the basis for appointment or dismissal, promotion, mobility, rewards and punishments, and determination of performance-based wages.

Chapter 7 Students

Article 54 Students refer to those who are admitted by a school in accordance with the law, obtain admission qualifications and have a school enrollment record.

Article 55 Students shall enjoy the following rights in accordance with the law while at school:

(1) To receive school education on an equal basis, participate in various activities arranged by the school’s education and teaching plan, and use the education and teaching resources provided by the school;

(2) Participate in social practice, volunteer service, work-study program, cultural and sports activities, and scientific and cultural innovation activities, and receive guidance and services on mental health, employment and entrepreneurship, etc.;

(3) Apply for scholarships, grants and student loans;

(iv) fair access to opportunities for study, exchange and further education at home and abroad;

(5) Receive scientific and fair evaluation in terms of ideology, morality, academic performance, etc., and obtain corresponding academic certificates and degree certificates after completing the academic studies required by the school;

(6) Organize and join student groups on campus, participate in school management in an appropriate manner, and enjoy the right to know, participate, express opinions, and supervise matters related to the school and students’ rights and interests;

(7) To make comments or suggestions on teachers’ teaching methods, teaching results, and teacher ethics;

(8) If they object to the punishment or treatment given by the school, they may file a complaint with the school or the education administrative department; if the school or the teaching staff violates their personal rights, property rights or other lawful rights, they may file a complaint or initiate a lawsuit in accordance with the law;

(IX) Other rights provided for by laws, regulations, rules and this Charter.

Article 56 Students shall perform the following obligations in accordance with the law while in school:

(1) They must love the motherland, love socialism and support the Communist Party of China;

(2) abide by the Constitution, laws and regulations;

(3) Comply with the school charter and various rules and regulations;

(4) Study hard, abide by academic ethics, and complete the academic work required by the school;

(5) To safeguard the reputation and legitimate interests of the school;

(6) Pay tuition fees and related expenses in accordance with regulations and fulfill the corresponding obligations of obtaining student loans and scholarships;

(VII) Observe the code of conduct for students, respect teachers and elders, and develop good moral character and behavioral habits;

(8) Other obligations required by laws, regulations, rules and this Charter.

Article 57 Students may organize or join student groups on campus in accordance with school regulations. The school supports student groups to conduct independent activities and self-management within the scope of laws, regulations and school management systems.

Article 58 The school supports and guarantees that the Student Congress and the Graduate Student Congress carry out activities in accordance with their charters and participate in the democratic management and supervision of the school.

Article 59 The school commends and rewards student groups and individuals who have made outstanding achievements and won honor for the school.

The school will impose disciplinary sanctions on students who violate school rules in accordance with regulations.

Article 60 The school shall set up a student complaint handling committee to accept and resolve student complaints. The composition and working procedures of the student complaint handling committee shall be implemented in accordance with the student complaint handling regulations.

Article 61 The rights and obligations of non-school-age students who receive training, continuing education, on-the-job learning or other types of education at school shall be determined in accordance with the relevant regulations of the state and the school or the provisions of the education service agreement.

Chapter 8 School and Society

Article 62 The University shall follow the principle of mutual benefit and provide services for the national and local economic and social development in various forms in accordance with the law. The University shall strengthen exchanges and cooperation with government departments, industry organizations, enterprises, institutions, scientific research institutes, and social groups, serve the local area in various ways, and strive for support and help from all sides.

Article 63 The school shall sign cooperation agreements with other institutions of higher learning, scientific research institutions, government departments, enterprises, institutions and other entities in accordance with the law, jointly establish relevant institutions, and carry out cooperative education, academic research, technological development, social practice, etc.

Article 64: Units with independent legal personality organized, invested in or affiliated with the school shall be subject to the supervision and management of the school and shall implement relatively independent operation and management in accordance with laws, regulations and school rules.

Article 65 The school shall establish non-affiliated affiliated hospitals, teaching hospitals and internship bases according to the needs of talent training and relevant regulations, expand teaching resources and improve the quality of education and teaching.

The rights and obligations of non-directly affiliated hospitals, teaching hospitals and practice bases shall be implemented in accordance with the provisions of the cooperation agreement.

Article 66 The University shall establish the Guangdong Pharmaceutical University Council (hereinafter referred to as the Council) according to the needs of its development. The Council is an advisory, consultative, deliberative and supervisory body to support the development of the University. It is an important organizational form and institutional platform for the University to achieve scientific decision-making, democratic supervision and social participation. The Council shall perform its duties and carry out activities in accordance with its charter.

Article 67 The school shall establish the Guangdong Pharmaceutical University Alumni Association (hereinafter referred to as the Alumni Association) in accordance with the law. The Alumni Association is a non-profit social organization registered and established by the school in accordance with the law and formed by alumni on a voluntary basis. It is responsible for coordinating and managing alumni affairs and carrying out activities in accordance with the Alumni Association Charter. The Alumni Association may establish alumni branches.
The school’s alumni include people from all walks of life who have studied, worked, or received various honorary degrees and honorary titles from the school and its predecessor institutions.

The school provides educational and other services to alumni, regularly informs alumni of the school’s development, and encourages alumni to participate in the school’s construction and development.

Article 68 The University shall establish the Guangdong Pharmaceutical University Education Development Foundation (hereinafter referred to as the Education Development Foundation) in accordance with the law, accept donations from all walks of life, manage and operate the fund in accordance with the law.
The Education Development Foundation is a non-profit corporate entity formally registered and established by the Guangdong Provincial Department of Civil Affairs.
The University shall give full play to the positive role of the Education Development Foundation in strengthening the University’s ties and cooperation with all walks of life at home and abroad, absorbing social donations, raising funds, etc., and expanding educational resources.

The composition, operation, rules of procedure and other matters of the Education Development Foundation shall be implemented in accordance with the Articles of Association of the Education Development Foundation.

Article 69 The school shall actively accept social supervision and implement information disclosure in accordance with the law.

Chapter 9 School Assets

Article 70 The main sources of school operating funds include:

(1) Income from fiscal subsidies;

(2) Subsidies from higher authorities;

(3) income from business activities;

(4) operating income;

(5) Income turned in by affiliated units;

(6) Donation income;

(VII) Other income.

The school actively expands the sources of funding for running schools, encourages and supports various units within the school to raise funds for teaching and research from the society, expands business development funds, and continuously increases investment in running schools.

Article 71 The school shall independently manage and reasonably use the state-owned assets it owns, occupies or uses in accordance with the law.

The school has established management systems for asset allocation, use and disposal, and implemented an asset management system of “unified leadership, centralized management, hierarchical responsibility and individual accountability”.

Article 72 The school implements a financial management system of “unified leadership, hierarchical management, and centralized accounting”, establishes and improves various financial rules and regulations such as financial budget, internal control, economic responsibility, and financial information disclosure management and supervision systems, regulates the school’s economic order, and ensures the safety of fund operation. The school establishes and improves the internal audit system and implements internal audits of the school and its affiliated units.

Article 73 The University attaches great importance to the protection and reasonable use of intangible assets. The University uses the intellectual achievements of faculty and students in accordance with laws, regulations or agreements.

Chapter 10 School Logo and School Anniversary

Article 74 The school motto is “Study Chinese and Western medicine, and save the world with medicine.”

Article 75 The school spirit is “to be determined and diligent, and to be flexible and innovative”.

Article 76 The school emblem is designed with the full name of the school in Mao-style calligraphy, the English abbreviation GDPU, the olive branch symbolizing medicine and life, the kapok flower symbolizing Guangzhou, the vibrant Guangzhou Pharmaceutical University, and the year the school was founded in 1958. The school emblem is circular, with dark blue as the standard color, representing the ocean of knowledge, the depth of science and technology, and rational thinking, and contains the style of study, teaching and school spirit. The main theme of the school emblem’s visual communication is that the school’s teachers and students are brave enough to climb the peak of science and technology and fly freely in the ocean of knowledge. Article 77 The school has the exclusive right to its logo.

Article 78 The school anthem is “Writing a New Chapter for Chinese Medicine”.

Article 79 The school anniversary is November 18th every year.

Chapter 11 Supplementary Provisions

Article 80 This charter is the basic principle for the school to run schools in accordance with the law, manage itself and perform public functions. The school establishes a system with the charter as the core, and the school management system and methods should comply with the spirit of this charter and shall not conflict with this charter.

Article 81 The formulation and revision of this charter shall be discussed by the school faculty and staff congress, reviewed by the principal’s office, approved by the school party committee plenary meeting, and submitted to the Guangdong Provincial Department of Education for approval.

Article 82 This Charter may be amended according to the needs of the development of education. Amendments to the Charter may be proposed by any of the following parties:

(1) the principal;

(2) One-third or more of the members of the Standing Committee of the Party Committee of the university;

(3) Three or more delegations from the Faculty and Staff Congress;

(4) A joint signature of more than one-third of the representatives of the Faculty and Staff Congress;

(V) A combination of five or more secondary units (including colleges and administrative departments);

(6) A joint letter from more than 1/3 of the representatives of the Student (Graduate Student) Congress.

A motion to amend the Articles of Association shall be accompanied by a draft of the proposed amendment.

The decision to revise the charter shall be made by the full committee of the school party committee with the consent of more than 1/2 of all members.

Article 83 This charter shall be interpreted by the full committee of the school party committee.

Article 84 This charter shall be announced to the public by the school after approval by the Guangdong Provincial Department of Education.
